What data of yours do we process? And, for which purposes?
When we receive data from you, this data is solely processed for purposes for which we received and collected it.

Data processing for other purposes is only possible if the legal requirements according to art. 6 sec. 4 GDPR apply in this respect. We will of course observe possible obligations to inform according to art. 13 sec 3 GDPR and art. 14 sec. 4 GDPR.

What is the legal basis for this?
The legal basis for the processing of personal data is basically – insofar as there are no specific legal provisions – art. 6 GDPR. Here, particularly the following options are possible:

  • consent (art. 6 sec. 1 lit. a) GDPR)
  • data processing to fulfil contracts (art. 6 sec. 1 lit. b) GDPR)
  • data processing based on a balancing of interests (art. 6 sec. 1 lit. f) GDPR)
  • data processing to fulfil a legal obligation (art. 6 sec. 1 lit. c) GDPR)

When personal data is processed based on your consent ,you have the right to revoke this consent given to us at any time with future effect.

When we process data based on a balancing of interests, you, as the data subject, have the right to object to the processing of personal data taking the specifications defined in art. 21 GDPR into account.

How long is the data stored?
We process data as long as it is required for the respective purpose.
Insofar as there are statutory retention obligations – e.g. as per commercial law or tax law – the respective personal data is stored for the duration of record retention. After retention obligation has expired, it is reviewed whether or not further processing is required. If it is no longer required, the data is deleted.

As a basic principle, we review data at the end of a calendar year in regard to whether or not further processing is required. Based on the volume of the data, this review takes place in regard to specific types of data or purposes of processing.

Of course you can request information at any time (see below) regarding your personal data we store and if there is no necessity, request a deletion or restriction of processing.

Which recipients receive the data?
Your personal data is only transferred to third parties if this is required to execute the contract we have with you, the transfer is permissible based on a balancing of interests in terms of art. 6 sec. 1 lit. f) GDPR, we are legally obligated to transfer the data or you have given your consent.

Where is the data processed?
Your personal data is exclusively processed in computer centres within Europe.

Your rights as a “data subject”
You have a right of access regarding your personal data that we process.

If you make a request for information that is not in writing, please understand that we have to request verification, if applicable, to verify that you are the person you claim to be.

Furthermore, you have the right to have processing corrected or deleted or restricted, insofar as you are entitled to this by law.

Moreover, you have the right to object against processing in line with legal provisions. There is also a right to data portability in line with data privacy regulations.

In particular, you have a right to object to the processing of your data in connection with direct marketing purposes according to art. 21 sec. 1 and 2 GDPR, if this takes place based on a balancing of interests.
